Reinstatement of Scabs

WHEREAS 384 PSAC members are under suspension for crossing previous picket lines of their bargaining group; and

WHEREAS the PSAC CRA, CFIA, Parks and TB Table 1, 2 and 3 bargaining groups will be in a legal strike position at some point over the summer of 2004; and

WHEREAS there is no incentive for suspended members to honour a picket line; and,

WHEREAS Regulation 19, paragraph 15 provides for the reinstatement of membership in certain circumstances:

BE IT RESOLVED THAT the NBoD consider members who have been suspended from membership under Section 25 (5) (n) to have met the requirements for reinstatement under Regulation 19, paragraph 15 if the suspended member participates in picket line activity of a subsequent strike by his/her bargaining unit. For greater certainty, this means that the suspended member will have to show that he/she was on strike during every day on which strike action is called, and participated on the line on those same days; and

BE IT FURTHER RESOLVED THAT the NBoD Discipline Committee review requests for reinstatement under this motion, and if the criteria have been met recommend reinstatement, retroactive to the date the member first participated in a legal strike of his/her bargaining unit; and

BE IT FURTHER RESOLVED THAT members reinstated under this motion be eligible for strike pay in the same manner and in the same circumstances as any other member once their fine has been paid.
